Terms of Service

1. Agreement to Terms

By downloading, installing, or using CoTrainer (“the App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Blue Edgewater Consulting (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

2. Description of Service

CoTrainer is an AI-powered performance consulting and instructional design application available on Android via Google Play. The App uses artificial intelligence to help users diagnose performance gaps, design training interventions, create training assets, and generate leadership briefing documents.

CoTrainer is a productivity tool intended to support — not replace — professional judgment. All outputs should be reviewed and validated by a qualified professional before being acted upon or shared with organizational stakeholders.

3. Eligibility

You must be at least 13 years of age to use CoTrainer. By using the App, you represent that you meet this age requirement. The App is intended for professional use by individuals working in training, human resources, organizational development, management, or related fields.

4. User Accounts and Subscriptions

Free tier: CoTrainer offers a free tier with limited daily builds, limited saved projects, and access to a subset of builders and advisor voices. Free tier features are subject to change.

CoTrainer Pro: Premium features are available through a paid subscription (CoTrainer Pro) billed monthly or annually. Subscriptions are managed through Google Play and RevenueCat. By subscribing, you authorize recurring charges to your payment method at the subscription rate in effect at the time of each billing period.

Cancellation: You may cancel your subscription at any time through Google Play. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except as required by applicable law.

Free trial: If a free trial is offered, it will be clearly disclosed. Your subscription will begin automatically at the end of the trial period unless you cancel before the trial ends.

5. Acceptable Use

You agree to use CoTrainer only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App to generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to circumvent, disable, or interfere with the App’s security features or usage limits
• Use the App to generate training content that misrepresents professional qualifications or credentials
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated tools to access or scrape the App’s API endpoints
• Share your subscription access with other users (each subscription is for individual use)
• Use the App in any way that violates applicable laws or regulations

6. AI-Generated Content

CoTrainer uses artificial intelligence to generate outputs including training assets, diagnoses, intervention plans, and leadership briefs. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or omissions
• AI outputs are starting points for professional work, not finished deliverables ready for distribution without review
• We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content
• You are responsible for reviewing, validating, and taking responsibility for any content you use or share that was generated with CoTrainer’s assistance
• CoTrainer’s outputs do not constitute professional legal, medical, financial, or HR advice

The learning science frameworks referenced in CoTrainer (Kirkpatrick, Gilbert’s BEM, Bloom’s Taxonomy, etc.) are accurately represented to the best of our knowledge, but you should verify applications of these frameworks against primary sources for high-stakes professional use.

7. Intellectual Property

Our property: The App, including its design, code, voice system prompts, glossary content, builder question banks, and all other original content, is owned by Blue Edgewater Consulting and protected by copyright, trademark, and other intellectual property laws.

Your content: You retain ownership of the content you enter into the App (situation descriptions, diagnostic answers, notes) and the outputs you generate using the App. By using the App, you grant us a limited license to process your content through the Anthropic API for the purpose of generating requested outputs.

Generated outputs: Training assets, diagnoses, intervention plans, and leadership briefs generated through CoTrainer may be used by you for personal and professional purposes. You may share these outputs with colleagues, clients, and stakeholders. You may not sell or commercially license CoTrainer-generated content as a standalone product.

8. Privacy

Your use of CoTrainer is also governed by our Privacy Policy, available at cotrainer.app/privacy, which is incorporated into these Terms by reference.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

CoTrainer is an instructional design support tool. It is not a substitute for professional HR, legal, medical, or organizational development advice. Training decisions made using CoTrainer are your responsibility.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUE EDGEWATER CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Blue Edgewater Consulting and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the App at any time by uninstalling it. Sections 7, 9, 10, and 11 survive termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, through an in-app notification. Continued use of the App after changes constitute your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Oregon.
